officers arrived and in about five minutes, they found a 30-year-old hispanic man found shot in the chest. he was alive at the time they arrived. he was pronounced dead at the scene. police say one person reportedly heard arguing a couple hours earlier. >> earlier reports show that there was an argument about 2:00 in the morning. now, we find a body in the same area. we believe that everything happened here. so far, officers tell us that they don't have any word on any suspects or a motive out here. we also asked about, is this a gang-related shooting. they said, at this point, it is too early to tell. their investigation now. as i mentioned, we are waiting for the homicide unit to make their way out here. we are told they will be out here in 2340er minutes or so to investigate san jose's ninth homicide of the year. live in san jose, marla tellez, "today in the bay." >> we are also following breaking news out of afghanistan

where two americans were killed in what is called an insider attack. 8-10 others are seriously wounded and the number killed could rise given how badly they are heard. a shooter said to be dressed in afghan military uniform walked into a u.s. special operations post opening fire. that shooter was shot and killed. today marks the first time americans have been killed by an enemy contact in afghanistan since january 7th. also new this morning, b.a.r.t. police investigating a gruesome scene overnight in which a man was crushed to death on the top of an elevator at the montgomery b.a.r.t. station. "today in the bay" bob redell joins us live. do they know why this man was on top of the elevator shaft in the first place? >> reporter: they can't get into his mind. they do believe he was a homeless man who had been sleeping on top of the elevator car. they came to this conclusion, because they saw some bedding material up there and found some of his personal affects. i was talking to some other

people that live on the street and live down below the streets in montgomery. trying to get an idea is this something you have seen before? it is too dangerous. it is not like the elevator shaft is any warmer than the rest of the concourse. this happened around 9:30. there was a passenger in the elevator riding from the muni level to the b.a.r.t. concourse level. they heard a crunching sound and a scream and the elevator automatically stopped. when the firefighters arrived, they found the man inside the shaft. they declared him dead on the scene. it is not clear if he was sleeping on top of the elevator and that's when he was crushed or if he had somehow slid between the elevator car and the wall. it did take the firefighters several hours to remove his body. his body was removed sometime after midnight. they are still trying to figure out how this man was able to get

in tear. that passenger stuck in the elevator, that person was able to get out. the elevator doors have now been boarded up with plywood. not there when that was restored. reporting live here outside montgomery, i'm bob redell in the bay the mother of an oakland woman would like you to help find her daughter. she disappeared while out on her jog. christie smith is here with new details on this case and where people will gather to try and find this young lady. good morning. >> reporter: good morning to you, john. i just got off the phone with one of the organizers. he tells me they are going to be meeting at 7:00 this morning at 34th and international -- or 34th and telegraph where she was last seen trying to canvas the area. they are trying to gather

information from her cell phone. it went dead thursday afternoon. the 31-year-old was last seen thursday morning. a surveillance camera spotted her jogging at 8:00 in the morning wearing gray sweats from top to bottom. she hasn't been seen since. she lives and works in oakland. her mom traveled all the way from fresno desperate for answers. >> now, she is not here with us. we want to know where she is. because this is not like her to just disappear. >> we are told she had a plane ticket to see her brother in dallas on friday. she had that but never used it. volunteers at the first congregational church in oakland gathered that night. they planned out what they are going to do. some family members say they are not too pleased with oakland response. those volunteers also tell me they are going to be gathering this evening again at 7:00 at that same church to regroup and

plan ideas to continue their search. reporting live in oakland, christie smith, "today in the bay." the world's cardinals are meeting this morning for the final time before locking themselves inside the vatican to start selecting a new pope. it begins in less than 24 hours and will not end until a new pope is officially selected. a media blackout surrounding the process. we are getting some hints. the decision may be a very tough one. francis george from chicago admitted that the will of god is not entirely clear. coming up at 6:30, we will go live to the vatican and vatican city for an update on when we could see the results of the very first vote let's get an update when it comes to the forecast. daylight savings time, the sun will set a lot later. >> indeed. it is 7:30. you can do some of your outdoor activities a little bit longer in the day. you have more daylight to walk the dog, hike, bike, whatever

for this time of morning, we often see the lights turned on just before 6:00. it looks like the east shore freeway flow is moving smoothly enough that they have not yet turned on those lights. we will look out to the maps. we see the approach. smoothly, the east shore does show slowing. your commute is easier for 580 as well as 880. we see the build for 101 from 680 up towards the airport and 680 northbound at mckie. two cars are involved. just off of capitol expressway. this is capitol avenue at murtha drive where the ninth homicide is being investigated. marla tellez is at the scene. capitol expressway is uninterrupted. a little slowing coming out of

hills. a little track but a significant ale sig alert is in place. take it down the coast through el granada. it is on 92. track that. south bay 80 slows. i want to make sure i show you that bay bridge toll plaza shot. not the toll plaza but the shot of the lights. here you see the metering lights turned on the last few minutes. the traffic flow across the bridge is fifrn but the backup at the toll plaza goes back quickly going past west grand avenue. a little early and a little heavy, guys. a new video of a rescue from a well in southern california. a man seriously hurt after he fell 35 feet down a well in the town of petrero. he was trapped in a cold, dark

space five feet in diameter for more than two hours. yesterday, firefighters had to race against rising water and an uneven surface to pull him finally to safety. no word on his condition. he was there trying to repair the well when he fell in. the well is the family's only source of water. four days after the deadly lion attack at a central valley wildlife park. cat's haven held a moment of silence for diana hanson. she worked as an intern at the wildlife sanctuary in dunlap, 40 miles southeast of fresno. she was killed by a lion while cleaning its cage. the board president of cat haven says the reopening has the blessings of the victim's family. hanson's family has started a fund-raiser in diana's memory for the animal park redwood city deciding whether we will ban single use

plastic bags. 42 million are used annually in that city. 400 million in san mateo county. if adopted, it could take effect as soon as april 25th. today, palo alto city council will vote to expand its ban on plastic bags. it will ban plastic bags from delis, restaurants, catering trucks and all other places that serve food. the only exception would be small bags to hold takeout items such as soup. palo alto bans plastic bags at grocery stores and other retailers you can see a little spring in the air. coming up, giants and a's getting ready for opening day. one of the starters may be out for the count. we'll tell you who next. the world champion giants, those trophies are ready to make another stop on the peninsula. for your first day?

good monday morning. i'm laura garcia can none. >> i'm jon kelley. in less than 24 hours from right now, the world's cardinals will lock themselves into vatican city and start the process of selecting the brand new pope. "today in the bay's" tracie potts is in vatican city. with you tell us what are you hearing lately? >> well, what we are hearing and what we are seeing right now, we are sort of in a waiting period, sort of a mid-day holding pattern. the cardinals wrapped up their final general meeting before they start the conclave. a couple of things happening. we got a briefing from the vatican dodd. later today, they will move the 115 electors are moving into casa santa marta. that is the vatican residence where they will stay together, cut off from the rest of the

world until this process is over. also, those staff members who are helping out in the conclave helpi helping process and assist with those votes, will be sworn to secrecy later on today. who might they select? the field seems to be wide open. take a look. a couple of frontrunners include some of those well-known in the vatican. cardinal scola. also, some americans like cardinal o'malley from boston, sean o'malley, considered one of those that may be elected, not to mention cardinal oeullet from canada and cardinal sheerer. a couple of those may be considered. experts say the possibility of an american pope is there. it is an outside chance but unlikely. dr. robert moynahan, the founder and editor and chief of "inside

the vatican" magazines tells us there is a drawback to selecting an american as pope. >> that would look to the rest of the world as if the religious power was sort of allies with the secular power. that would be a concern, even to the cardinals. >> we will have live reports from the vatican until the next pope is official chosen. we do have some breaking news we are following in san jose where police are investigating the city's ninth homicide of the year. a man was found shot to death near the intersection of murtha drive and east capitol expressway. very close to the scene there. "today in the bay's" marla tellez just spoke to police. she is live with an update. >> reporter: laura, good morning. right now, the san jose homicide unit is arriving. you can see that as we give you a live look. this is all happening on south capitol avenue and murtha drive. it is so early in their investigation that police are saying they don't have any word on the suspect or even a motive.

what we can tell you is that it was actually a neighbor that found the man's body as she went to work early this morning. she called her husband to tell him, hey, something does not look right. so the husband, he took a look for himself and called 911. about 4:25, police arrived to find a man, described as a 30-year-old hispanic man, shot in the chest. they say he died at the scene. they also tell us he may not be a stranger to police. >> we have had officers believe that they might have made contact with him in the past in the neighborhood. i am not sure for what. he has not been identified yet. >> a neighbor tells us he did not hear anything. he is surprised to wake up to a crime scene. >> reporter: you don't usually see san jose police out here? >> no. >> reporter: that neighbor lives

the span itself. i hear word from our traffic source. they have to close the freeways so that helicopter can land safely and get out of the area. because the helicopter is heading over there, there is not really super thick fog if they can see. still, christina is talking about fog along highway 1. folks will have to take the northern route through montara and take sharp road over towards 280. you do know about that route. the slow foing for 880. south through sinegal. it is 6:36. still ahead, we have brand new video just in of a plane that slit off of a runway at the houston airport. we'll have the latest details coming up next. plus, the latest developments in the case against

as america begins military drills with south korea. north korea says the annual practice is a preparation for an invasion. they have threatened to launch a nuclear strike against the u.s. and break the nearly 60--year-old army stis that ended the korean war. south korea says the drills are for defense purposes. last week, they voted to impose more sanctions on north korea which angered pyongyang. new developments in the case against olympian oscar pistorius. his lawyers are appealing the restrictions. they say he is not a flight risk and should have the opportunity to travel outside the area. he is charge with murdering his girlfriend, reeva steenkamp. he says he mistakenly shot her thinking she wasse an intruder

6:44. new this morning. what was he doing there in the first place? an overnight accident at the montgomery b.a.r.t. station when a man on top of an elevator shaft is crushed to death. "today in the bay's" bob redell is live with new details on the investigation. good morning, bob. >> reporter: good morning to you, laura. based on the bedding material and other personal effects found on top of the elevator itself, b.a.r.t. believes this was a homeless man that had taken up residence in this shaft here at the montgomery b.a.r.t. station. this is video from down stairs. the only indication something has happened. you see the elevator door has been boarded up. around 9:30, the passenger was riding the elevator up from the

muni level to the bar concourse level. the elevator automatically stopped. it is not clear if this man was crushed while on top of the elevator or if he had somehow slid in between the elevator car and walls of the shaft. the fire department pronounced him dead on scene. it took them several hours to remove his body. b.a.r.t. is still trying to figure out how this man was able to get into the elevator shaft in the first place without being noticed by anyone. the passenger stuck in the elevator was able to get out unharmed. reporting live, bob redell in the bay. >> 6:45. a trial starts this morning on a massive wrongful termination suit against the lawrence livermore lab. five ex worke-workers appearing court claiming they were let go because of their age. the group part of a larger suit, lab officials say age had nothing to do with the layoff. the employees were let go back in 2008 shortly after lawrence livermore lab was privatized by

the bechtel corporation. >> let's talk about the forecast for today. the weather has been spectacular. it really has. all week long. unfortunately, we are not getting those beautiful sun rises to show you. i kind of do want to show you what's happening. we have faced our camera. sets in the west, rises in the east. the sun, as you can see here, starting to make a little bit of an appearance as you can see in san jose. we faced our camera east. i will show you san francisco where we faced our camera to the west. it is still rather dark at 6:46. we are starting to get a little bit of sunlight. sunrise is officially going o to come up at 7:30. it will set at 7:15 in the evening. a lot more daylight to take care of your business after work. nonetheless, still dark in the morning. you want to travel cautiously, specially if you are taking your little ones to school. thick pockets of fog up in santa rosa. watch out as you are traveling

traffic alert, mike? definitely, christina. this is a major injury crash over here, highway 92. somewhere between skyline and half moon bay. you know it is only one or two lanes in each direction through that span. if you are coming over from 280, turn around and go back and head north and head to sharp park and get on the highway 1. if you are coming out of half moon bay, head up towards montara and fa sieve ka and across to 280 and back down through the area. freeways themselves are clear. as christina noted, highway 1, you may get some patchy fog. highway 92 currently closed between skyline and half moon bay because of a major injury crash. let's get a quick look at 101. this is along the coastal route of the peninsula. heading up towards the dunbarton

bridge. the south bay shows the build but it is holding off at north 101, north 87 and starting to build for north 85. a gentle build for the northbound directions. marla tellez is at this investigation of a homicide. watch capitol avenue at murtha still closed. 880 heading up toward the toll plaza. a lot of company. the toll plaza had a lot of company a communitywise search is under way for an oakland woman who simply disappeared while out on her morning jog. where we are, which is 34th and telegraph, where she was last seen. they are also going to hit a number of bus stops all the way over to the mcarthur b.a.r.t. station trying to find erika masaleras. she was last seen on thursday, wearing jogging clothes, gray sweats, thursday morning around 8:00 a.m. when a surveillance camera at a bakery caught her jogging. thats wa the last time anyone had seen her. her cell phone went dead that afternoon. investigators are trying to find out where and when it was last on and used. she was jogging and had been doing so since losing her husband to cancer last february. her mom is desperate to find her. >> she just went and walked away. her family loves her. her community loves her. so we just want people to know about this so that they can help us get her back. >> volunteers gathered at a

new details after a weekend prostitution sweep. undercover officers arranged to meet these women and local hotels and arrested them. some women had large amounts of cash. two women were from san jose, one from oakland, one from va lay owe and two others from southern california. a homeowner living in the east foothills area of san jose. he said police broke into his home stealing $20,000 worth of valuables. he says he also suffered a break-in when a tracking app he installed on a stolen ipad sent a north san jose address to his phone. even with the evidence, the investigating officer told majors, there wasn't anything they could do. >> it's frustrating. i know the police are doing the best they can at the resources they are given.

i don't know who to point the finger at. it makes you think about movering to morgan hills, quite frankly. i was born and raised here in san jose. >> police sergeant jason dwyer tells us investigating burglaries is time-consuming. officers can write search warrants but getting them executed is very labor intensive in manpower. residents with evidence are encouraged to provide it to the p.d. police say they are swamped with calls and have to prioritize violent crimes. property crimes are on the rise all over the bay area. in san jose, burglaries, robberies and auto theft were up last year by 30% over the year before. there were similar trends in san francisco, oakland, and fremont. critics says police just aren't giving enough high priority to property crimes because of staffing reductions and budget cuts. >> berkeley's famed chez pannise

restaurant has starting taking reservations. fire damaged the restaurant and forced them to close the doors. the owner hopes to be able to open a portion of the dining room very soon. it is not clear how long it will take to repair the entire building google ordered to pay to settle a multi-state investigation. mountain view company has agreed to pay $7 million after investigators found collected e-mails and passwords ond other sensitive information over wireless networks while collecting information for its mapping service. about 30 states will split the settlement expected to be announced later this week. not that big of a deal when you are talking about a company expected to make $61 billion a year. $7 million is about how much google makes an hour. $7 million an hour. facebook is trying to build up excitement for its new news

contact with the victim in the past in the same area that leads them to believe that the victims may have lived in this area. this is right near the capitol expressway corridor. that traffic is completely unaffected. there is just about a city block that's closed off on south capitol avenue. that's not going to affect the morning rush-hour. it was a husband and wife that found the man's body lying in the street as they left for work this morning. they called 911 close to 4:30. police found the hispanic man in his 30s shot in the chest. he died at the scene. he has yet to be identified. a couple hours earlier, one person heard shouting. this could be linked to this deadly shooting. >> based on earlier reports, we believe there was an argument at 2:00 in the morning.

>> from nbc news, this is "today" with matt lauer and savannah guthrie, live from studio 1a in rockefeller plaza. and good morning, welcome to "today" on a monday morning. i'm matt lauer. >> i'm savannah guthrie. >> we are following breaking news out of afghanistan this morning. an insider attack at a police station just west of kabul. >> here's what we know. at least two u.s. service members are dead. we want to get right to mike in kabul this morning. give us the latest. >> reporter: this happened at about 10:30 this morning, a coalition military source told nbc news that a single gunman dressed in an afghan local police uniform, he may have either been a local police officer or dressed like one, entered into a group meeting that included coalition forces and afghan forces, took out his weapon and opened fire. there were at least two dead and a number of other casualties.
